Architectural Control

Per Article VII of the Declaration of Covenants, Conditions and Restrictions for 1600 Hamilton Place Community Association, the following Architectural controls have been set forth:

Architectural Committee Approval

No building, fence, gate, wall, pool, spa, obstruction, outside or exterior wiring, balcony, screen, patio, patio cover, tent, awning, garage, carport, carport cover, improvements or other structure shall be commenced, erected or maintained upon the Properties or any portion thereof, nor shall any exterior addition to or change or alteration of the Common Area or Exclusive Use Common Area be made, until a written application for approval of the proposed work supported by plans and specifications showing the nature, color, kind, shape, height, materials, and location of the same, has been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board of Directors or its designated Architectural Committee (which shall be composed of representatives appointed by the Board).

Said plans and specifications shall be submitted to the Board by personal delivery or first-class mail to the Secretary of the Association, Manager of the Association, or the Chairperson of the Architectural committee.

Additional Information

The Board or Architectural Committee shall have the right to request additional information regarding the work of improvement if the request is delivered to the applicant in writing within thirty (30) days following the date the initial application was filed. The Board also may determine if there is opposition to the application by one or more neighbors in which case the Board may request written comment from the affected neighbor(s).

The Board shall make its decision and recommendations within sixty (60) days following the date of receipt of the application or, in the event that such additional information has been requested of the applicant, within sixty (60) days after such additional information is received. If the Board fails to approve, deny, or make a request for additional information in writing within sixty (60) days of the completion of the application, the same shall be deemed to be unconditionally approved.

Architectural Standards

The Board may, from time to time, adopt and promulgate Architectural Standards.

Owner Responsibility

By approving plans and specifications, the Board and the Architectural Committee do not assume any liability or responsibility for compliance with building or zoning ordinances, which compliance shall be the sole responsibility of the applicant No Owner may make or cause any alteration which would adversely affect the structural integrity of any building or which would impair the effectiveness of sound control between residences.

Common Area

No improvement, excavation or work which in any way alters any Common Area from its natural or existing state shall be made or done except upon strict compliance with, and within the restrictions and limitations of, the following provisions in this section.

No person other than the Association or its duly authorized agents shall construct, reconstruct, refinish, alter or maintain any improvement upon, or shall make or create any excavation or fill upon, or shall change the natural or existing drainage of, or shall destroy or remove any tree, shrub, or other vegetation from, or plant any tree, shrub, or other vegetation upon the Common Area.
